1. Definitions
1.1 “Seller” refers to Home in Balance Inga Fira-Jurkowska, Avenue Petit Senn 41c, 1225 Geneva, Switzerland, email: info@homeinbalance.eu.
1.2 “Customer” refers to any individual or legal entity purchasing digital products from the Seller.
1.3 “Digital Product” refers to online courses, downloadable materials, or any other digital content offered for sale by the Seller.
1.4 “Platform” refers to the online learning platform through which the Customer accesses purchased Digital Products.
1.5 “Order” refers to the process by which the Customer purchases Digital Products via the Seller’s website.
1.6 “Terms” refers to these Terms and Conditions.
2. General Provisions
2.1 These Terms govern the sale of Digital Products by the Seller to the Customer via the Seller’s website.
2.2 By placing an Order, the Customer confirms that they have read, understood, and accepted these Terms.
2.3 The Seller reserves all intellectual property rights to the Digital Products, website content, and any related materials.
2.4 By placing an Order, the Customer confirms that they are at least 18 years old or have the consent of a legal guardian.
3. Technical Requirements
3.1 To access Digital Products, the Customer must have an internet-enabled device with an updated web browser, JavaScript enabled, and cookies allowed.
3.2 The Seller is not responsible for any inability to access Digital Products due to the Customer’s technical setup.
4. Ordering Process
4.1 Orders can be placed through the Seller’s website www.homeinbalance.eu by selecting the desired Digital Product and completing the checkout process.
4.2 The Customer will receive an email confirmation of the Order once payment is successfully processed.
4.3 All prices are stated in Swiss Francs (CHF) and include applicable taxes, if any. The Customer is responsible for any additional local taxes or duties that may apply in their country.
5. Payment Terms
5.1 Payment must be made in full at the time of ordering.
5.2 The Seller accepts payments via Stripe, which supports major credit and debit cards.
5.3 Payments are processed securely via Stripe. The Seller does not store or have access to the Customer’s payment card details.
5.4 The Digital Product will be accessible only after payment is successfully completed. Access is granted immediately after successful payment.
5.5 The Customer has the right to request an invoice. To receive an invoice, the Customer must provide the necessary invoice information when placing the order.
5.6 If payment for the order cannot be collected due to technical issues or other unforeseen circumstances, the Seller will notify the Customer immediately after the issue occurs.
6. Delivery of Digital Products
6.1 Upon successful payment, the Customer will be granted access to the purchased Digital Product via the Platform.
6.2 Delivery is considered complete when access details are sent to the Customer’s registered email address.
7. Right of Withdrawal & Refund Policy
7.1 Under Swiss law, the right of withdrawal does not apply to digital products once access has been granted or the download has begun.
7.2 By purchasing a Digital Product, the Customer acknowledges and agrees that they waive their right to withdraw once access to the content is provided.
7.3 Refund Policy: All sales of digital products are final. No refunds will be issued once access to the digital content has been granted. Exceptions may be considered only in cases of technical errors where the Customer is unable to access the Product and the issue cannot be resolved by the Seller.
8. Complaints Procedure & Customer Support
8.1 Any complaints regarding Digital Products should be sent by email to info@homeinbalance.eu.
8.2 The Seller will respond to complaints within 14 days of receipt.
8.3 If the complaint is justified, the Seller will take appropriate corrective measures.
8.4 For questions regarding your order, technical issues, or billing inquiries, please contact info@homeinbalance.eu. The Seller aims to respond within 2 business days.
9. Liability
9.1 The Seller is not liable for interruptions in access to the Online Store and the Training Materials resulting from force majeure, hardware or software failures, technical errors, disruptions in the power supply, third-party actions, or any other unforeseen circumstances preventing or limiting access to the Online Store and use of the Training Materials.
9.2 The Seller is not liable for damages resulting from the Customer’s use of the Training Materials resulting from the Customer’s failure to comply with the Terms and Conditions, improper use of the Training Materials, or use of the Training Materials in a manner contrary to their intended use.
9.3 The Seller is not liable for the content of Customer comments and reviews posted on the Store’s Website.
9.4 The Seller is not liable for disruptions in the delivery of the Training Materials resulting from the Customer providing false or incomplete data.
9.5 The Seller is not liable for damages resulting from the actions of third parties who have gained access to the Training Materials with the Customer’s consent.
9.6 In the event that the Seller is liable to the Customer, such liability is limited to the price paid by the Customer for the Training Materials.
9.7 The Seller shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, loss of data, loss of reputation, loss of economic benefits, any financial loss, or other damages not directly related to the Customer’s personal injury.
9.8 Any disputes between the Customer and the Seller regarding the provision of electronic services and the sale of Training Materials will be resolved by a court of competent jurisdiction in accordance with the provisions of the Code of Civil Procedure.
10. Final Provisions
10.1 These Terms are governed by Swiss law.
10.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
10.3 The Seller reserves the right to amend these Terms at any time.
10.4 These Terms and Conditions are provided in English. In case of discrepancies between translations, the English version shall prevail.
The Regulations enter into force on August 15, 2025.
